1. Acceptance of Terms
By accessing or using the Arxion platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Arxion Labs reserves the right to modify these terms at any time. Continued use after changes constitutes acceptance.
2. Description of Service
Arxion provides trading analytics, market intelligence, wallet tracking, and AI-powered coaching tools. The Service is informational only and does not constitute financial advice. Arxion does not execute trades, hold custody of funds, or manage assets on your behalf.
3. User Accounts
You must authenticate via Google OAuth to access the Service. You are responsible for maintaining the security of your account. You agree not to share your session or access credentials. You must be at least 18 years old to use the Service.
4. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse-engineer, decompile, or extract source code; (c) use automated scripts or bots to access the Service without authorization; (d) resell, redistribute, or sublicense any data obtained through the Service; (e) interfere with or disrupt the Service infrastructure.
5. Intellectual Property
All content, algorithms, models, branding, and design elements are the exclusive property of Arxion Labs. You are granted a limited, non-exclusive, revocable license to use the Service for personal, non-commercial purposes. No rights are transferred beyond what is expressly granted.
6. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, express or implied. Arxion does not guarantee the accuracy, completeness, or reliability of any analytics, signals, or data. Trading cryptocurrencies involves significant risk of financial loss. You acknowledge that you use the Service at your own risk.
7. Limitation of Liability
In no event shall Arxion Labs be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or trading losses, arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.
8. Termination
Arxion Labs may suspend or terminate your access at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 7, 9, and 12 survive termination.
9. Refund & Cancellation Policy
All subscription payments are processed in cryptocurrency via third-party payment processors. Due to the nature of digital currency transactions, all sales are final and non-refundable. You may cancel your subscription at any time; cancellation will take effect at the end of the current billing period, and you will retain access until then. No partial refunds are issued for unused portions of a billing cycle. If you believe a charge was made in error, contact [email protected] within 7 days.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Canada.
11. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms, the parties agree to first attempt to resolve the dispute informally by contacting each other. If the dispute cannot be resolved informally within 30 days, the parties agree to submit the dispute to binding arbitration in accordance with the rules of the applicable arbitration authority in Canada. Each party shall bear its own costs of arbitration.
12. Indemnification
You agree to indemnify, defend, and hold harmless Arxion Labs, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
14. Entire Agreement
These Terms of Service, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Arxion Labs regarding your use of the Service. These Terms supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter hereof.
